All licensees should be familiar with this form. It will save time and avoid confusion. A copy is at the end of this email.
First, in California, Real Estate licensees do not need to complete any continuing education courses if they are over 70 years of age and have had their license (sales or broker) in good standing for 30 continuous years in the state. This form can be used to request the exemption, and more detailed information is attached.
There is one bold footnote. Sacramento licensing cannot provide the date first licensed over the phone. Submit a request in writing and be ready to wait three to four weeks for a response.
By the way, the state and education providers do not have any information about your age, so requesting this benefit is up to you. As you can understand, education providers do not like this exemption. We believe licensees over 70 should complete education to better protect themselves and the public.
Second, this form is used to request an extension to your license expiration date. You must have submitted, in good faith, evidence of completing attendance of 45 hours of continuous education, but DRE finds that some portion of the submission is not acceptable. The extension would be for 90 days.
A student of ours last week submitted their course number and transposed some numbers. DRE sent information giving them 90 days to correct the submission.
The following situations may also qualify the licensee for an extension:
- Health reasons preventing attendance;
- Active duty in the military service with assignment to a permanent duty stationed outside of the estate during the last 18 months of a license period;
- Other compelling cause beyond the control of the applicant while engaged in the real estate business.
Be ready to recommend this form when you hear someone mention that they have a problem in one of these areas. I can tell you from experience that not many licensees know about this form. Be the genius in your office.
